Information, Rules, and Regulations of North Willow, Inc.

General Information
  1. Name and Purpose: North Willow Club, Inc. is an Indiana not-for-profit corporation which was organized to (a) hold legal title to the clubhouse and all common properties in North Willow Farms; (b) provide a means for funding, and hence, maintaining the common properties; (c) provide the homeowners with an organization for self-government in their immediate community; and (d) supply a forum through which the neighborhood social and recreational needs may find expression.

  2. Membership: Membership in North Willow Club, Inc. is limited to North Willow Farms homeowners.

  3. Government: A twelve member Board of Directors governs the corporation. The directors are divided into three classes of four directors. Each class of director is elected for a three-year term so that four new directors are elected each year at the annual meeting of the members.
    • The directors utilize the committee system for furthering the work of the board.
    • The officers of the corporation are President, Vice-President, Secretary, and Treasurer. Officers need not be directors.
    • The corporation is chartered by the State of Indiana accordance with the terms of its Articles of Incorporation. The internal operation of the corporation is governed by its by-laws.

  4. Dues: The annual dues of the club are payable annually, semi-annually or quarterly. Dues may be increased annually in proportion to increases in the consumer price index of the United States Department of Labor. General increases and special assessments may only be made upon a 2/3 vote of the entire membership after thirty (30) days written notice to homeowners. Any assessment is considered dues.

  5. Property Management: The Corporation employs a professional management company which facilitates maintenance of the entrances, common areas and facilities, helps enforce the protective covenant, and administers dues collection.

  6. Unpaid Dues: Delinquent dues are collectible by appropriate legal proceedings with interest and reasonable attorney fees. Delinquent dues will result in suspension of clubhouse, pool, tennis court and common ground privileges till dues are current. A late fee of $10 will be assessed monthly if payment of dues is not made by the last day of the first month of each quarter, total fee not to exceed $25.

Common Properties and Recreational Facilities
  1. Rules Governing Use: Unless specified in this directory, the rules governing use of common properties and recreational facilities are those posted on site.

  2. Motorized vehicles on common properties: No motorized vehicles shall be driven or ridden on common properties except in the clubhouse parking lot and then only for the purpose of entering, leaving, or to park.

  3. Maintenance of common properties: It is the policy of North Willow Club, Inc. subject to the discretion of the Board of Directors, to provide the following services on common properties (clubhouse grounds, courts and cut-outs):
    • Mowing, fertilizer, weed and insect control;
    • The removal of dead trees;
    • The pruning of trees and shrubs on the clubhouse grounds.
North Willow News
North Willow Club, Inc. publishes a community newsletter called the North Willow News. The newsletter is published and disseminated once a month. The deadline for articles and announcements is 11 a.m. on the day of the monthly Board meeting. The following polices apply to the publication of items in the North Willow News:
  1. Only North Willow residents may submit items to be published.

  2. All requests to publish items must be in writing and include the name, address, and telephone number of the requestor. Advertisements and announcements should be submitted to the office manager.

  3. Classified advertisements will be printed at a rate of $5 per three lines. Lost and found ads will be printed for free. A complete list of the rules and prices for advertisement can be obtained in the clubhouse office or from the Board member in charge of Communications.

  4. All requests to publish items for not-for-profit organizations must be submitted by a resident who is a member of the organization.

  5. Complaints directed toward one identifiable resident will not be published.

  6. The Board of Directors reserves the right to reject any item submitted for publication and to make exceptions to these policies whenever, in its discretion, exceptions are deemed to be appropriate.

  7. All items submitted for publication are subject to being edited prior to publication.

Covenants and Restrictions
The recorded plats of the various sections in North Willow Farms contain uniform covenants and restrictions. The covenants and restrictions exist for the benefit of all homeowners and are enforceable. The covenants and restrictions govern the size, character and aesthetic appearance of all permanent structures, preclude outdoor storage of boats and campers, and govern the size design, location and materials for fences and fencing. Neither structures nor fences or fencing may be erected without permission first obtained from the North Willow Farms Zoning/ Architecture Committee. Applications for approval of structures, fences, or fencing shall be submitted through the office of the club managers together with supporting sketches or diagrams showing all dimensions and a list of materials to be employed. Information and Rules Adopted by the Board of Directors
The information and rules contained herein have been approved by the Board of Directors and may be disseminated to homeowners. The Board of Directors reserves the right to alter, amend or revoke the foregoing information and rules at any time and from time to time.

Guidelines on Fences
North Willow Farms was the first planned community in Marion County. Along with this plan, a great deal of thought, effort and money have been devoted to making the community an attractive and pleasant place to live. One of the important aspects of the development plan for North Willow is the open space concept. This concept involves an open atmosphere, which resembles a park instead of a rigidly subdivided tract.

Because of this concept, homeowners in North Willow are discouraged from erecting fences to circumscribe their property. However, homeowners have a legal right to erect fences. To insure that such fences did not impinge too seriously on the open space concept, the land was developed with binding restrictive covenants. The covenants require a homeowner to obtain the approval of the Board of Directors of the North Willow Club, Inc. before erecting a fence.

To assist in the compliance with these covenants, the Board has created a Zoning/Architecture Committee for the purpose of reviewing requests for approval of fences, and that committee has adopted the following guidelines which will be applied in reviewing requests for approval.
  1. Fences must be of an “open” variety, consistent in design with the natural open atmosphere in the community.

  2. Fences are limited to : chain link, rail, or board and post construction. Rail and board fences may not include more than three (3) horizontal members, and these horizontal members may be no greater than six (6) inches in width and no less than six (6) inches apart.

  3. Fences must be of a color and design which is compatible with the surroundings.

  4. Fences may be erected only in the rear of the dwelling, and no fence or spur will be permitted to be erected forward of the rear of the dwelling. Where the lot is adjacent to the common property of a pedestrian easement, the fence must be at least five (5) feet inside the property line.

  5. No fence may exceed forty-eight (48) inches in height. This restriction applies to hedges and planted screens.

  6. Perimeter Fencing. A six (6) foot privacy fencing or natural screening is allowed. The six-foot fence shall be of the shadow box variety. This type of fencing is allowed only on the perimeter boundaries of North Willow Farms.
The above guidelines are not intended to apply to patio or privacy screen fences, which may be erected at or near the rear of a dwelling. These privacy fences may be no taller than six (6) feet and may screen an area no greater than five hundred (500) square feet. These fences must also be compatible with the surroundings, and approval of the Board is necessary. All requests for approval of fences should include a diagram of the property showing the line on which the fence will be placed. The diagram should also include the location of all buildings on the lot.
